Tax Collections

New York Tax Collection Lawyer

The Internal Revenue Service (IRS) and the New York Department of Taxation and Finance have broad tax collection powers. They also have procedures in effect that will allow a taxpayer the ability to compromise their tax liabilities at substantially less than the liability being sought. The Law Offices of Hugh Janow has a successful track record structuring agreements with the Federal and State taxing authorities that would allow a business to continue to operate despite substantial delinquent tax liabilities.

At The Law Offices of Hugh Janow, we represent clients in Collection Due Process Hearings, Interest and Penalty abatement requests and installment agreement requests. Our firm has a good working relationship with IRS and Department of Taxation and Finance personnel. We will ensure your case is heard. Offers in Compromise or Let's Make a Deal

There are many ways an experienced tax attorney can work with the government to arrange an acceptable repayment plan. In some instances, you may arrange a payment that satisfies your tax liability by paying less than the amount you owe in delinquent taxes. This is called an offer in compromise. Some of the grounds for obtaining an offer in compromise are:

  • Doubt as to Liability: Where the IRS will allow you to pay less than what you owe if there is doubt as to the accuracy of your tax liability.
  • Doubt as to Collectability: A situation where the IRS will accept less than the full payment of tax liability if there is doubt concerning your ability to satisfy your debt, also called reasonable collection potential.
  • Effective Tax Administration: Where a collection of unpaid debt would cause an undue hardship on a taxpayer, the IRS accepts a client's offer.

What if an offer in compromise cannot be obtained? The Law Offices of Hugh Janow still has other strategies to allow their clients to reduce their liability and/or negotiate an acceptable installment agreement. The Law Offices of Hugh Janow will often find errors on the original tax return liability, additional deductions, or credits that will, in turn, reduce tax, interest and penalties. Mr. Janow is quick to point out that a $1 tax savings on an old liability can reduce overall liability by $3 - $5 or more. Additionally, Mr. Janow is knowledgeable in potential defense techniques for some parties, such as innocent spouse relief which can minimize liability in tax disputes.
